Plaintiff failed to explain apparent inconsistency between his application for disability benefits and his ADA claim that he could continue to work.

Williams v. London Utility Com'n, 375 F.3d 424 (6th Cir. July 8, 2004) - This is an ADA action. Dewey Michael Williams was the superintendent of the London Utility Commission. On February 28, 2001, he was fired by the Mayor. On March 1, 2001, he applied for disability benefits. Later, he brought this action alleging breach of contract and alleging violation of the ADA. As to the ADA claim, the Sixth Circuit affirms the grant of summary judgment in favor of the employer because Williams did not satisfactorily explain the apparent inconsistency between his application for disability benefits and his ADA claim that he could continue to perform his job.
