Bailey v. U.S. Postal Service, 208 F.3d 652 (8th Cir. April 3, 2000) - In this Title VII action, the federal employee failed to show that she consulted an EEO Counselor within 45 days of the alleged discriminatory incident. Furthermore, she was not entitled to estoppel because she did not show that her failure to timely pursue her claim was the consequence of either a deliberate design by the Postal Service or of actions that the Postal Service should have understood would cause the employee to delay pursuing her claim.
